The actions you take in the first few days after an accident can greatly influence the success of your injury claim. Here are the recommended actions:

Document Everything

Take photographs of the accident location, your injuries, and any damaged property. Collect the contact information of any witnesses and preserve any physical evidence that supports your claim.

Do Not Admit Fault

Even though you may think you said something minor, an admission of fault can be used by an insurance company to reduce or eliminate your potential recovery.

Statute of Limitations In Florida

Most personal injury claims in Florida must be brought within two years of the date of the injury-causing accident. FAQ

How Long Do I Have to File a Personal Injury Claim in Florida?

Typically, you have two years from the date of the incident where you were injured to file a personal injury lawsuit in Florida. Failure to file your claim in a timely manner will result in your losing the right to compensation. There are exceptions to the general rule of two years – for example, if your claim involves a governmental entity or if you did not discover the nature and extent of your injury until after the two-year period has expired – please consult with us as soon as possible to preserve your rights.

If I Was Partially Responsible for the Accident, Can I Still Recover Damages?

Yes, under Florida’s Modified Comparative Fault Statute, if you are partially responsible for causing the accident, you can still recover damages for your injuries – provided you were not more than 50% at fault. The amount of your recovery will be reduced by your percentage of fault. Therefore, an attorney experienced in handling personal injury cases can assist you in defending any allegations of comparative negligence by the other party in order to maximize your recovery.

How Long Will My Case Take?

Unfortunately, there is no standard answer to how long a personal injury case will take to resolve. Simple cases that settle quickly could potentially be resolved in a matter of weeks. More complex cases, however, which involve serious injuries, disputed issues of liability, or an insurer that is unwilling to make a reasonable settlement offer, could take anywhere from six months to two years or longer to resolve – and possibly even longer if litigation becomes necessary.
